According to the award documentation, the claimants asserted claims for breach of fiduciary duty, violations of the Pennsylvania Unfair Trade Practices and Consumer Protection Law, suitability, professional negligence, breach of contract and breach of the duty of good faith and fair dealing, failure to supervise and vicarious liability by Morgan Stanley Smith Barney and Charles Alan Correal.
The claimants allege that respondents invested their funds in risky and unsuitable energy stocks, including Seadrill, Ltd., Copano Energy LLC, and Interoil.
The customer dispute was filed in February 2016 alleging unsuitable investment recommendations, among other allegations. The complaint alleges $180,000.00 in damages of which $110,000 was recovered in the final award.
Charles Alan Correal left Morgan Stanley in June 2016 and is now employed by Harvest Financial Corporation (CRD# 8733).
Morgan Stanley (CRD#149777) employed Charles from 2009 until his departure in June 2016. Charles operated out of Morgan Stanley’s Upper St. Clair, Pennsylvania branch. According to Charles’s detailed CRD report, he had three other customer complaints while at Morgan Stanley

This requires that the broker: Investigates and conducts due diligence into the investment’s attributes including its benefits, risks, tax consequences, and other relevant factors to form a reasonable basis for the recommendation of the product; and appropriately matches the investment with the customer’s specific investment needs and objectives, such as the customer’s retirement status, long or short-term goals, age, disability, income needs, or any other relevant factors.
